Based on the ruling issued, it is established that Yoel Quispe was fatally injured during a confrontation with one of the young men from the second group he encountered. Both the Provincial Court and the judge of the Investigative Court number 1 of La Coruña ruled out that the physical assaults prior to the victim could have triggered the subsequent homicidal act, thus contradicting the theory presented by the family.
The judges of the provincial court pointed out that there is no evidence of a prior agreement between the individuals involved in the incident or of complicity in the execution of the act that cost Yoel his life. It is indicated that two groups of young people, with no prior relationship between them, were involved in the events, according to the evidence gathered so far.
The victim participated in a previous fight with two individuals who were part of the first group of those involved, according to witnesses and documentary evidence. Despite the attempts by the family prosecution, the Provincial Court rejected expanding the list of those investigated for the crime from three to five, maintaining the consideration that the act was carried out by a few individuals.
During the confrontation, one of the investigated, in preventive detention, would have delivered the fatal stab to Yoel after obtaining a knife from a friend. It is suggested that the fight broke out when the victim perceived a threat from the other individuals involved, culminating in the tragic outcome.
The Court concluded that the two individuals pointed out by Yoel's family had no direct relationship with the material author of the crime. Thus, the appeal filed by the victim's mother was dismissed, confirming the order issued by the Investigative Court number 1 of La Coruña.
Regarding the case of Yoel Quispe, the investigation considers the three investigated as members of a group that came to Yoel's defense during the fight with another group. Evidence such as the knife used in the attack, a video showing part of the confrontation, and the testimony of several witnesses, which support the version of events disseminated by the investigation, are highlighted.
